Approvals, certifiers and building disputes in Cobbitty

Most new Cobbitty homes are approved either through a development application to Camden Council or a complying development certificate, followed by a construction certificate. From there, your principal certifier attends the critical stages and, once satisfied, signs off the occupation certificate. None of that replaces a defect inspection for the owner. If problems are not fixed, put them to the builder in writing, then lodge a complaint with NSW Fair Trading, and if that does not resolve it, apply to NCAT.

Development approval comes from Camden Council or a certifier through complying development.

The principal certifier carries out critical stage inspections and issues the occupation certificate.

Home Building Compensation Fund cover through icare applies to most residential work over the threshold.

Disputes go to the builder first, then NSW Fair Trading, then NCAT.

NCAT evidence needs an expert witness report written to Procedural Direction 3.

FAQ

Approvals, certifiers and building disputes in Cobbitty: common questions

Does Camden Council inspect my house?

Usually not during construction. The principal certifier you or your builder appoint carries out the mandatory inspections.

Where does NSW Fair Trading fit once a complaint is lodged?

It can arrange a building inspection and try to resolve the complaint. If that fails, NCAT can make binding orders.

Will a defect report be accepted at NCAT?

Not as expert evidence. You need an NCAT expert witness report prepared under Procedural Direction 3.
